Idaho Notary Stamp/Seal Requirements

Idaho requires an ink stamp on all notarial acts (effective October 1, 2018).
Stamp requirements (Idaho Code §§ 51-117, 51-118):
- Shape: Rectangular (not exceeding 2¼" × 1") or circular (not exceeding 1¾" diameter) with a serrated or milled edge border
- Must include: Notary's name, "Notary Public", "State of Idaho", commission number
- May optionally include: "My commission expires:" followed by expiration date
- Must be an inked stamp (embosser alone is not sufficient)
- Idaho notaries file their oath directly with the Secretary of State (no county filing required)

Idaho does not require notaries public to maintain a journal of notarial acts, though the Idaho Secretary of State strongly recommends that notaries keep a journal as a best practice.

Right to inspect:
- Because journal-keeping is optional in Idaho, there is no statutory right to inspect a notary's journal.
- If a notary voluntarily maintains a journal, access would depend on the notary's willingness to provide information or a court order compelling production.

What can be requested:
- If a journal exists: recommended entries include date and time, type of notarial act, document description, signer's printed name and address, identification method and credential details, signature of signer, fee charged.
- Thumbprint: Idaho law does not require thumbprints.

Key considerations:
- Idaho adopted the Revised Uniform Law on Notarial Acts (RULONA) in 2019, effective January 1, 2020. Despite the adoption of modern notary standards, journal-keeping remains optional for traditional notarizations.
- If a journal is maintained, the Idaho Secretary of State recommends retaining it for at least 10 years from the date of the last entry.
- Because journals are optional and there is no statutory inspection framework, obtaining journal information typically requires cooperation from the notary or a subpoena duces tecum.
